That, notwithstanding anything in Standing Orders, whereas the All-Party Oireachtas Committee on the Constitution has been involved in a full review of the Constitution on an All-Party basis since its establishment in July 1996, and re-establishment in October 1997 and again in December 2002 with the following terms of reference:

the All-Party Oireachtas Committee on the Constitution may sit as a Joint Committee of both Houses of the Oireachtas and for this purpose:

(1) A Select Committee, consisting of the mem-bers of Dáil Éireann set out in the Schedule to this Resolution be appointed to be joined with a Select Committee to be appointed by Seanad Éireann to form the Joint Committee on the Constitution to consider matters comprehended by the preamble to this Reso-lution and, in particular, issues relating to property rights, in like manner, as it may select and see fit and shall report thereon to both Houses of the Oireachtas.

(2) The quorum of the Joint Committee shall be 3, of whom at least 1 shall be a member of Dáil Éireann and 1 a member of Seanad Éireann.

(3) The Joint Committee shall have the powers defined in Standing Order 81(1), (2), (3), (4) and (8).

36. "That Dail Eireann:

— noting that the average price for a new home nationally now stands at €198,000 and, in Dublin, stands at €256,000, therefore excluding all but the wealthiest first time buyer;

— recalling the abolition of the First Time Buyers Grant and the increased VAT on homes, both of which have added further to the burden placed on those trying to enter the housing market;

— noting that 52,726 families were on waiting lists for local authority housing while only 4,403 new units were completed last year;

— deploring the lengthy waiting lists for disabled persons housing grants, the changes made to the eligibility criteria for such grants and the failure of the current level of disabled persons housing grants to meet demand and modern construction costs; and

— believing that Government figures of 5,581 homeless people are a gross underestimate of the true figure;

condemns the Government for denying young people the aspiration to own their own home, for failing to provide adequate housing to those who have applied to their local authorities for a suitable home for their families and for ignoring the plight of so many people who have been left without any home at all and:

— demands that the Government recognise the vital nature of the home in the lives of Irish people;

— requires the establishment of a national Housing Agency to reduce bottlenecks in the housing market and planning system;

— demands that the proceeds of lands and properties being disposed of by the Office of Public Works be used firstly for the construction of social housing;

— calls for the publication of the promised review of the disabled persons housing grant scheme and related schemes, on foot of Government cutbacks that is forcing elderly and disabled people to go without essential facilities like downstairs toilets, stair lifts and showers; and

— calls on the Government to change its policy in neglecting the young and the vulnerable towards one which encompasses social justice and provides for the housing needs of the entire population." — Bernard Allen, Padraic McCormack, Enda Kenny, Bernard J. — condemns the decision of the Government to cancel the order for five medium lift helicopters for the Air Corps which will have serious implications for the viability of the Air Corps and the effectiveness of our search and rescue services;

— a shipment of plutonium mixed oxide was delivered to Japan in 1999 from British Nuclear Fuels Limited (BNFL) but, because crucial safety data was found to be falsified by BNFL, Japan refused to accept the fuel and it is now being returned to the United Kingdom, and

— the MOX is expected to be shipped through the Irish Sea and thus poses an unacceptable risk to the marine environment, coastline and population of Ireland;

calls on the Irish Government to:

— protest the shipment to the Japanese and British Governments;

— welcome the formation of a citizens’ flotilla of small yachts to peacefully express the Irish people’s opposition to the shipment;

— protest the proposed level of security as inadequate and demand an armed military escort capable of meeting any threat from terrorism accompany the shipment;

— request that the United States Administration, which must authorise the security arrangements of the transport, conduct a ‘threat assessment’ in the light of the new security situation created by the September 11th terrorist attack;

— demand that the Japanese and British Governments conduct a full, comprehensive and public environmental impact assessment in consultation with Ireland prior to the voyage;

— demand that the Japanese and British Governments consult with Ireland to formulate contingency plans and emergency preparations in case of an accident or incident;

‘26. (1) Every sitting of the Dáil shall be governed by a printed Order Paper, which shall be prepared under the direction of the Ceann Comhairle.

(2) The Taoiseach shall have the right to determine the order in which Government business shall appear on the Order Paper and, by announcement at the commencement of public business, the order in which it shall be taken each day; and may propose, on motion made without notice at the commencement of public business, arrangements for sittings and for the taking of such business until such business has been disposed of; save where any such proposal is opposed, the Ceann Comhairle shall permit a brief statement from a representative from each party in opposition and the Taoiseach before he or she puts the question thereon.

(3) Following the announcement by the Taoiseach and the disposal of any motion compre-hended by paragraph (2), the Ceann Comhairle may permit, at his or her discretion–

(a) a brief question not exceeding two minutes from each Leader in Opposition to the Taoiseach about a matter of topical public importance and in respect of which the following arrangements shall apply:

(i) The Taoiseach shall be called upon to reply for a period not exceeding three minutes,

(ii) The Leader in Opposition who asked the original question may then ask a brief supplementary question not exceeding one minute,

(iii) The Taoiseach shall then be called upon in conclusion for a period not exceeding one minute.

(b) the total time allowed for Leaders’ Questions on any given day under this Standing Order shall not exceed twenty-one minutes and the Taoiseach may nominate another member of the Government to take Leaders’ Questions in his or her absence.

(c) in this Standing Order, "Leader in Opposition" means the leader of a group as defined in Standing Order 114(1): Provided that the Leader of a party which is a group under Standing Order 114(1)(a) shall have precedence over the designated Leader of a group recognised under paragraph (1)(b) of the Standing Order.

(d) questions from any member about business on the Order Paper; about the taking of business which has been promised, including legislation promised either within or outside the Dáil; about the making of secondary legislation; about arrangements for sittings; and as to when Bills or other documents on the Order Paper needed in the House will be circulated: Provided that, the Taoiseach may defer replying to a question relating to the making of secondary legislation to another day.’." — Enda Kenny, Bernard J.
