Bill entitled an Act to provide - (a) in accordance with the exigencies of the common good, for a measure of security of tenure for tenants of certain dwellings, (b) for amendments of the law of landlord and tenant in relation to the basic rights and obligations of each of the parties to tenancies of certain dwellings, (c) with the aim of allowing disputes between such parties to be resolved cheaply and speedily, for the establishment of a body to be known as the Private Residential Tenancies Board and the conferral on it of powers and functions of a limited nature in relation to the resolution of such disputes, (d) for the registration of tenancies of certain dwellings, and (e) for related matters.

— noting the recent critical Reports on the treatment of people with mental illness by Amnesty International, the Irish Psychiatric Association and the Inspector of Mental Hospitals;

— concerned that Irish mental health policy and service provision remain out of step with international best practice and that the institutionalisation of the mental health services in Ireland has failed to live up to World Health Organisation standards;

— believing that the high admission and readmission rates to psychiatric hospitals are due in large measure to the lack of community based facilities;

— concerned at the lack of dedicated psychiatric facilities for adolescents, the lengthy waiting lists for treatment and the lack of consistency in the provision of mental health services throughout the country; and

— deploring the fact that people with intellectual disability continue to be inappropriately accommodated in psychiatric facilities in violation of human rights law;

condemns the Government for its neglect of the mental health sector and failure to vindicate the human rights of people with mental illness and for the reduction in the percentage of the health budget spent on mental health and calls on the Government to immediately bring for-ward a comprehensive package of measures, including appropriate finances, to provide:

— a comprehensive, needs-based, service-user-led review of the mental health care ser-vices, promptly and fully implemented, ensuring that they meet international human rights standards and best practice in line with the World Health Organisation 2001 an-nual report, with an emphasis on community-based care;

— regular quality research in all areas of mental health care needs and service provision, an essential prerequisite for the development of a quality service;

— full financial provision for all areas of mental health care;

— all necessary resources and assistance for the Mental Health Commission in its secur-ing adequate care and conditions for people with mental illness;

— effective action on all relevant recommendations made in the reports of international treaty-based committees, annual reports of the Inspector of Mental Hospitals, and Gov-ernment reviews and reports;

— a comprehensive system of personal advocacy and an effective complaints procedure, to ensure that people with mental illness are assisted in exercising the full range of their rights;

— specialised mental health care for all who need it, including children, the homeless, prisoners, people with other forms of disability, travellers, asylum seekers and refugees, and other minority or vulnerable groups;

— a public education and awareness campaign to counter the stigma of mental illness, emphasising the rights of people with mental illness; and

— rights-based disability and mental health legislation to give full effect to its international human rights obligations, with due regard to its obligation to enable per-sons with disabilities to exercise their rights on an equal basis with other citizens."

37. "That Dáil Éireann:

— condemns the decision of the Government to cancel the order for five medium lift helicopters for the Air Corps which will have serious implications for the viability of the Air Corps and the effectiveness of our search and rescue services;

— noting, in particular, that the White Paper on Defence, which was approved by the Government in February 2000, recognised the urgent equipment modernisation requirements of the Air Corps and the repeated statements from the Minister for Defence that the acquisition of these aircraft would provide a major boost for the organisation and were required to enable the Air Corps to play a pivotal role in search and rescue operations for the foreseeable future;

— expresses concern also that the cancellation may jeopardise up to 1,500 jobs at FLS Aerospace in North Dublin, as agreement had been reached to provide significant additional business for the plant as part of the contract process;

and calls on the Government to reverse the decision to cancel the order and to ensure that procedures to provide the five helicopters are re-instated without further delay."

— condemns the decision of the Football Association of Ireland to enter into an arrange-ment to allow the pay channel, Sky Sports, exclusive rights to televise Irish home soccer internationals;

— notes that this move will result in many fans being deprived of the opportunity of watching the matches live on television and that it is likely to result in an increase in the number of young people and children viewing the matches in pubs;

— believes that this decision represents a betrayal of the fans who have loyally supported the Irish soccer team;

— deplores the failure of the Government to use the powers given to it by the Oireachtas in the Broadcasting (Major Events Television Coverage) Act, 1999, to designate these matches and other major sporting occasions as events of major importance to society for which the right of a qualifying broadcaster to provide coverage on free television services should be provided in the public interest;

— notes that there is nothing in Irish legislation or in the EU Directive, Television Without Frontiers, to prevent the Government from acting, even at this stage;

40. "That Dáil Éireann notes:

— a shipment of plutonium mixed oxide was delivered to Japan in 1999 from British Nuclear Fuels Limited (BNFL) but, because crucial safety data was found to be falsified by BNFL, Japan refused to accept the fuel and it is now being returned to the United Kingdom, and

— the MOX is expected to be shipped through the Irish Sea and thus poses an unacceptable risk to the marine environment, coastline and population of Ireland;

calls on the Irish Government to:

— protest the shipment to the Japanese and British Governments;

— welcome the formation of a citizens’ flotilla of small yachts to peacefully express the Irish people’s opposition to the shipment;

— protest the proposed level of security as inadequate and demand an armed military escort capable of meeting any threat from terrorism accompany the shipment;

— request that the United States Administration, which must authorise the security arrangements of the transport, conduct a ‘threat assessment’ in the light of the new security situation created by the September 11th terrorist attack;

— demand that the Japanese and British Governments conduct a full, comprehensive and public environmental impact assessment in consultation with Ireland prior to the voyage;

— demand that the Japanese and British Governments consult with Ireland to formulate contingency plans and emergency preparations in case of an accident or incident;

— demand that the Japanese and British Governments accept full and unconditional liability for any and all harm to Ireland, including its marine environment, arising from the shipment and

— in the light of recent public statements by senior Japanese officials about overturning Japan’s constitutional commitment to reject nuclear weapons, request an urgent public review by the European Union member states of the proposed EURATOM-Japan Peaceful Nuclear Cooperation Agreement."

notes with concern the considerable increase in the number of notified redundancies arising from the economic downturn;

condemns the refusal of a number of companies to pay redundancy terms recom-mended by the Labour Court;

believes that the current statutory redundancy scheme, which has not been updated for many years, is totally inadequate to compensate for the loss of a job, as a worker on the average industrial wage with 30 years service could qualify for as little as €10,307;

notes that the trade union movement regards this situation with sufficient seriousness that the ICTU has sanctioned nation-wide industrial action; and

calls on the Government to introduce amending legislation to provide for:

— an increase to three weeks pay for each year of service for redundant workers;

— a reduction in the qualifying period for entitlement to payments from two years to one; and

— a raising of the ceiling for the calculation of the lump sum to €635 per week and that this figure be index linked."

52. "That Dáil Éireann:

— expresses its deep concern at the major build-up of troops and weapons in the Gulf Region by the United States and a number of other countries, apparently in preparation for a war against Iraq at a time when the United Nations Arms Inspectors have not yet completed their mandate and when the Security Council has not yet considered what response, if any, is required to the report of the Inspectors;

— notes with alarm a recent UN report pointing to the potentially catastrophic consequences of a war, which include half a million direct or indirect casualties, the outbreak of disease and the displacement of hundreds of thousands of civilians;

— further expresses concern at the provision of facilities at Shannon Airport for US troops and equipment as part of the build up for war, especially without any reference to the Oireachtas; and

— condemns Saddam Hussein for the heinous crimes he has committed against his own people and calls on the Iraqi Government to comply in full with all resolu-tions of the UN Security Council;

calls on the Irish Government to:

— join with countries like France and Germany in efforts to avoid war and to promote a specific settlement of this dispute, in accordance with the principles of Article 29.2 of the Constitution; and

— suspend the provision of any facilities at Shannon Airport that could be used to facilitate preparations for a war against Iraq."

its opposition to unilateral attacks against Iraq;

that only multi-lateral action supported by the UN will be considered;

that prior Dáil approval for Irish refuelling or over-flight facilities will be sought if multi-lateral action is authorised by the UN;

that they have sought independent verification of the Blair dossier on Iraq which makes specific claims about Iraq’s weapon stocks;

condemns:

— the illegal and criminal invasion of Iraq by United States and British forces;

— the slaughter of large numbers of men, women and children in the US/British bombard-ment of cities and towns;

— the slaughter of large numbers of Iraqi conscripts by the massively more heavily armed forces of invasion and also the needless deaths of ordinary US and British soldiers;

declares:

— that the invasion is an imperialist venture to secure Iraqi oil fields and extend its control over the Middle East Region;

— that those who initiated this war bear full criminal responsibility for the consequent deaths and destruction;

notes that the US has announced that 120,000 more troops are to be sent to join the invasion;

demands that none of these troops be allowed facilities at Shannon Airport or at any other location in this State;

condemning the 8% reduction in funding for the Arts Council for 2003, constituting a reduction in funding from €47.7 million in 2002 to €44 million in 2003,and resulting in:

— the deferral and curtailment of many important arts programmes, making it impossi-ble for the Arts Council to meet their objectives as stated in the Arts Plan 2002 – 2006; and

— the inevitable loss of key personnel from arts organisations across the country, which is already having a seriously detrimental effect upon participation with, and access to, the arts nationally;

calls upon the Government:

— to immediately assess the current standing of all projects awarded monies under the Access Programme of the Department of Arts, Sport and Tourism, and to reallocate to the Arts Council any monies short-listed for projects that are now no longer to proceed;

— to provide €61.9 million funding to the Arts Council for 2004 as outlined in the Arts Plan 2002 – 2006; and

— to honour the commitment to support this third Arts Plan as detailed in the Fianna Fáil/ Progressive Democrats joint Programme for Government."

For the purpose of Article 17.2 of the Constitution, the Government recommend that it is expedient to authorise such payments out of moneys provided by the Oireachtas as are necessary to give effect to any Act of the present session to promote the use of the Irish language for official purposes in the State; to provide for the use of both official languages of the State in parliamentary proceedings, in Acts of the Oireachtas, in the administration of Justice, in communicating with or providing services to the public and in carrying out the work of public bodies, to set out the duties of such bodies with respect to the official languages of the State, and for those purposes, to provide for the establishment of the Office of the Official Languages Commissioner and to define its functions, to provide for the publication by the Commissioner of certain information relevant to the purposes of this Act and to provide for related matters.
