The advertising of human medicines in Ireland is regulated under the Medicinal Products (Control of Advertising) Regulations 2007 (S.I. No. 541/2007). These define ‘advertising’ of medicines as, “any form of door-to-door information, canvassing activity or inducement designed to promote the prescription, supply, sale or consumption of medicinal products.” The regulations apply through traditional media (e.g. print, broadcast, outdoor, etc.) and online media (e.g. websites, social media platforms, etc). The regulations prohibit advertising any human medicine that is not authorised or registered in Ireland. They also prohibit the advertising of prescription medicines to the public.

The HPRA operates an advertising surveillance programme to make sure the advertising of medicines for human use is in accordance with the regulations. If a breach is identified, the HPRA takes follow-up actions including the reporting and/or removal of online content.

The HPRA has recently published guidance on its website in relation to the promotion of medicines to the public on social media.

Under the Medicinal Products (Control of Advertising) Regulations 2007, the HPRA's remit, relates specifically to medicinal products and as such they do not have a role in regulating the promotion of cosmetic surgery or aesthetic procedures. The Advertising Standards Authority for Ireland (ASAI) may offer a view in relation to the other areas of interest.
